Write-In Candidate
The information provided on this website is for informational purposes only and does not constitute legal advice.
Definition/About
Write-in candidates provide a way for members of an association to add their names to the annual election ballot. However, write-in candidates are only permitted if explicitly allowed by the association’s election rules or governing documents, such as the bylaws. To be elected as a write-in candidate, an individual must meet any applicable qualifications outlined in the election rules and, if elected, should confirm in writing their willingness to serve on the Board of Directors. Write-in candidates are generally not permitted in cumulative voting, as discussed in Adams Stirling’s article on cumulative voting. Associations should refer to legal resources or attorney guidance for further clarification.
